On January 6, 2009, Obama’s attorneys filed a “Motion to Dismiss” — Civil Action No. 1:08-cv-02254-JR, GREGORY S. HOLLISTER, Plaintiff, v. BARRY SOETORO, et al., Defendants.
The MEMORANDUM OF PRESIDENT BARACK OBAMA AND VICE PRESIDENT JOSEPH BIDEN IN SUPPORT OF THEIR MOTION TO DISMISS Defendants President Barack Obama and Vice President Joseph Biden submit this Brief in support of their Motion to Dismiss. Plaintiff’s allegations are patently false and baseless,1 but even taking them as true for purposes of this Motion, the suit must be dismissed immediately. Plaintiff fails to establish the Court’s jurisdiction and he fails to state a claim upon which relief can be granted. Accordingly, the Court must dismiss the complaint with prejudice pursuant to Federal Rules of Civil Procedure 12(b)(1) and 12(b)(6).

That footnote is a bald-faced lie.
a. Obama never publicly produced a certified copy of a birth certificate. He produced an UNCERTIFIED copy of a Hawaiian “Certification of Live Birth,” that has been demonstrated to be counterfeit by Dr. Ron Polarik and forensic document examiner Sandra Ramsey Lines.
Dr. Polarik, who holds a Ph.D. in Instructional Media and specializes in computer graphics with over 20 years experience with computers, printers and typewriters, provides conclusive and irrefutable evidence that the Certificate of Live Birth (COLB) image created and distributed by Obama’s campaign to the Daily Kos, Annenberg’s Factcheck, and the St. Petersburg Times, and Politifact, is, unquestionably, a false identification document. ()
Ms. Lines has filed an affidavit [.pdf] associated with one of the many lawsuits challenging Obama’s eligibility to serve as POTUS, stating the following: “After my review and based on my years of experience, I can state with certainty that the COLB presented on the internet by the various groups, which include the ‘Daily Kos,’ the Obama Campaign, ‘Factcheck.org’ and others cannot be relied upon as genuine.”
Maya Soetoro-Ng, Obama’s half-sister, also has a Hawaiian COLB — and she was born in Indonesia. Hell, Sun Yat-Sen, the Father of Modern China, who was born in the village of Cuiheng, Xiangshan county , Guangzhou prefecture, Guangdong province, China, has one too.
b. An entry in a website, any website, is certainly not evidence of anything, especially the left-wing nut-bin, the Daily Kos and FactCheck.org, which is funded by the same organization that funds the unrepentant domestic terrorist Bill Ayers.
c. A newspaper birth announcement is meaningless, since the source could easily have been a telephone call from anywhere in the world.
d. Hawaiian officials have indeed confirmed the existence of a vault-copy birth certificate, but refuse to disclose its contents, saying, “State law (Hawai‘i Revised Statutes §338-18) prohibits the release of a certified birth certificate to persons who do not have a tangible interest in the vital record.”
The courts continue to find that nobody has “a tangible interest in the vital record” –sigh!
The BIG question is, since Hawaiian officials have confirmed the existence of such a “birth certificate,” why does Obama continue to spend millions of dollars in legal fees trying to hide it.
What is on that birth certificate that could be so damning?

Defendants Soetoro (a/k/a/ Obama) and Biden state Plaintiff’s (Hollister) allegations are false and baseless but does not state which allegations Defendants disagree with or why they disagree with the numerous allegations made by Plaintiff.
Also, Defendants move for dismissal for failure to state a claim, but this is an Inpleader case and a Request for Declaratory judgement. Plaintiff clearly outlines his assertion he as an asset (Recall to Mililtary Duty) and has requested the Court to solve the controversy of Soetoro (a/k/a Obama) qualifications to be POTUS.
Defendants have made a fatal mistake in that they have attacked this case on the basis of Plaintiff claiming injury and a demand for relieve and recovery. Plaintiff is claiming he has an asset; specifically, a recall to duty, forfeit of liberty if recalled and subject to a war crimes allegation if ordered by a usurper to a mission involving loss of life, liberty or property.
Plaintiff wants this Court to declare the qualified person to submit asset to if certain conditions arise.
Obama should have simply answered the with a Declaration he is the qualifed POTUS and asset should be submitted to him, the Commander in Chief, and that would have resolved the Interpleader case and request for Declaratory Judgement.
Unfortunately, Obama has used the Soetoro and Obama name interchangably in his answer and affirmed the controversy over Obama’s legal name. The only way this case can properly be dismissed is if the Judge fudges it for the sake of peace and tranquility in the Country.

Let’s hope that the “dismiss with prejudice” nonsense is hotly and loudly contested, too.

You know what really irk is that Obama can resolve all the lawsuites by showing his vault copy of the BC rather than spending a lot of money figthing the case. With that being said, I am also appalled with the judicial system. The judges, including the SCOTUS, could just subpeona the BC and that would be it. Not one of the judges had the gut to ask for Obama’s BC. Instead, the judges would dismissed all these cases on jurisdiction or standin and not on merit.

In fact, the two Hawaiian birth announcements were generated by the Department of Health which sent the notices directly to the two newspapers. At the time, the newspapers did not accept very short advertisments. Why not? Well one reason was that in 1961 very few people had credit cards.
In any case, the notices were sent by the Department of Health to the newspapers, which printed the small items as news. I have even seen a posting on line of a fellow whose child was born in Hawaii that he saw the notices in the newspaper even though he did not place an ad.
Second, even if you do not believe that the two birth notices were sent by the Department of Health to the two newspapers, it is frightening to think that you believe “the source could easily have been a telephone call from anywhere in the world.” That’s because the newspapers would have required proof of the birth.
That’s not to say that they would have required proof of the location of the birth, but they would have demanded to see the birth documents because if they were in the habit of just accepting birth notices without requiring proof, someone would post a birth notice as a prank or out of spite—and that would lead to a libel suit.
Today, now that the newspaper accepts short advertisements, and now that birth notices are advertisements, the two Hawaii newspapers always demand to see the birth certificate.
So it is not meaningless.

It is time to focus on REAL issues, not imaginary ones.
A fairly impressive internet industry has sprung up claiming that Obama was born in either Kenya or Indonesia. This is nonsense, which distracts from the broadly unexplored story of Obama’s upbringing. This kind of nonsense has emerged because the McCain campaign chose not to raise the many questions about Barack Obama’s numerous hard-left alliances. Barack Obama was born in Hawai`i, August 4, 1961 at Kapiolani Medical Center in Honolulu.
Obama’s birth certificate posted online is exactly the same birth certificate everybody in Hawai`i gets from the State Department of Health. It is not forged. There is nothing unusual about the design or the texture. In addition to the birth certificate, the August 13, 1961 Honolulu Advertiser also carries an announcement of Obama’s birth. The Honolulu Star-Bulletin also carries the same announcement. Both papers require submission of a copy of the birth certificate to print a birth announcement. [Note: That is today.
